Privacy policy

This Privacy Policy (“Policy”) covers how Ohsoboho Private Limited, a company incorporated under the laws of India, having its registered office at First Floor, No. 2062, 13th Cross, 23rd Main, HSR Layout, 1st Sector, Bangalore - 560102 (“we” / “us” / “OhSoBoho”) collects, uses, discloses, processes, transfers, stores and safeguards information received from visitors and users of our website located at www.ohsoboho.com and www.ohsoboho.in, or other platforms and services that we offer (collectively, “Platform”). We are committed to upholding the privacy and security of information supplied by every person accessing or using our Platform (“you”). Please take a moment to familiarise yourself with our privacy practices, and to learn about our information gathering practices. By accessing our Platform, you agree to be bound by, and acknowledge the acceptance of the terms and conditions of this Policy. You signify that you have read and understood this Policy. We further reserve the right to update or modify this Policy at any time without prior notice and all such changes will be effective immediately upon our posting the updated or modified Policy on the Platform. We will not be bound to inform you of any such modification. You are therefore encouraged to review this Policy each time you access or use the Platform. This Policy is in line with OhSoBoho’s commitment to comply with all data privacy and protection requirements under applicable law (“Data Privacy Laws”).

1. DEFINITIONS

  • Non-Personally Identifiable Information” is information that is either publicly available, or not personally identifiable to you such as anonymous usage data, general demographic information we may collect, referring / exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks.

  • Personally Identifiable Information” is non-public information that directly or indirectly, in combination with other information available with us, is capable of identifying you, and includes your first and last name, physical address, email address, phone number or additional registration data which you submit to us through the registration process on the Platform.

2. MINIMUM AGE AND ANTECEDENTS

Our Platform is not designed for use by anyone under the age of 18 (eighteen). If you are a minor, you must access and use the Platform through your parent / legal guardian. We do not verify the age of our users, nor do we have any liability for such verification or lack thereof. We may, at our sole discretion, delete information pertaining to, and suspend access to the Platform, of users suspected of being under the age of majority and using the Platform without the verifiable consent of their parent / legal guardian. 

3. INFORMATION COLLECTED 

In your use of the Platform, and the product and services that we provide, we may collect Personally Identifiable Information from you. While some of your information has to be mandatorily provided for your usage of the Platform, the provision of other information is optional and depends on the product and services being availed by you. Additional information may also be gathered from you during your subsequent uses of the Platform as and when you buy the products or avail services from us. You hereby consent to such collection, use, display, processing and handling of your information by us as described in this Policy, and as may be reasonably necessary to allow you to access and use the Platform. You also acknowledge and agree that all such information provided by you is accurate, true and up to date. You agree that we are not, in any manner, responsible for the correctness of information held by us in relation to you.

Personally Identifiable Information

  • Generally, you control the amount and type of information you provide to us when using our Platform. To browse the Platform, you will need to submit some necessary Personally Identifiable Information. You can create a profile with us by registering with the Platform, [entering your email address / phone number, and creating a user name and a password]. By registering, you are authorising us to collect, store and use your email address / phone number in accordance with this Policy. To further use the Platform, you will need to submit additional information, basis the services availed by you. You may choose not to provide such additional information, but this could prevent you from taking full advantage of our Platform’s various products and features. If you choose to input financial data into the Platform, we may collect and process information such as transaction details and bank accounts. If you choose not to provide such information, you may still be able to visit and browse our Platform, but you may be unable to access certain features and functions of our Platform and services. Based on the features of our Platform that you access or use, we may also be required to share your information, including Personally Identifiable Information with third parties in relation to the services being provided. You hereby agree and acknowledge that such collection and sharing is based on your voluntary consent. 

  • We also collect Personally Identifiable Information from you in non-digital contexts, including, for example, when you reach us over the phone or contact customer service over phone or / including communication channels such as email, WhatsApp, Instagram, Facebook, Twitter, etc.

  • As part of our digital marketing, we may provide third party services’ interfaces or links on the Platform to facilitate your sending a communication from the Platform. For example, we may use third parties to facilitate e-mails, tweets, “likes”, content submissions or postings of comments on Facebook or other social media platforms. We may also enable access to or display of third party content via the Platform that is actually being served or published by the third party, and such third party may be collecting data from you in connection with that content. These third parties may collect and retain any information used or provided in any such communications or other activities and these third parties’ practices are not subject to our Privacy Policy. When you use third party services, you are using their services and not our Platform and they, not we, are responsible for their practices. You should review the applicable third party privacy policies before using such third party services in connection with our Platform. 

  • You may also choose to provide us with access to certain Personally Identifiable Information stored by such third parties as described above. We will have access to such information to the extent specifically authorised by you and where applicable, allowed by your privacy settings. In the event that there is an association between such information and any account you hold with us, you agree that we may collect, process, store and use the information in accordance with this Privacy Policy.

Information via Technology and Cookies

  • In an effort to improve the quality of the Platform and the products and services made available to you, we collect information about how you use the Platform including log data and interactions with the Platform, and track other information provided to us by your browser or by our software application when you view or use the Platform, such as the website you came from, the type of browser you use, the device from which you connected to the Platform, the time and date of access, and other information that does not personally identify you. 

  • We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. You consent to such transfer and the application of the Data Privacy Laws to the exclusion of law applicable in your jurisdiction.

  • You acknowledge that you are licensing to us the right to use, modify, display, distribute and create new material from the information provided by you through the Platform and the provision of services by us, and that by providing such information, you automatically agree to such a licence without the payment of any fees. You understand that information we collect may be collated, aggregated, analysed and used to generate statistics, and for our internal research and development. 

  • In general, we use Non-Personally Identifiable Information to help us improve the Platform and customise user experience. We also aggregate Non-Personally Identifiable Information in order to track trends and analyse use patterns on the Platform. This Policy does not limit in any way our use, licensing, reproduction, distribution, disclosure, sale or aggregation of Non-Personally Identifiable Information and we reserve the right to use and disclose such Non-Personally Identifiable Information to our partners, advertisers and other third parties at our discretion and you hereby consent to the same.

  • We share some of the collected information with third party analytics tools in order to produce intelligent insights, detect and remove fraudulent data, including spam, and offer better services. 5. SHARING OF INFORMATION

  • We do not sell, rent or otherwise provide your Personally Identifiable Information to third parties for commercial gain. We may however, use your Personally Identifiable Information for the purposes of marketing. We may also provide your Personally Identifiable Information to sub-contractors, vendors, third party service providers or affiliate or group entities that provide services to us in furtherance of our Platform, product and services. Such sub-contractors, vendors, third party service providers or affiliate entities will only receive the information necessary to provide the respective services to us. While we will endeavour to ensure that such parties have in place a privacy policy similar to ours, or are bound by confidentiality obligations of such nature before sharing your information with them, we will not, in any manner whatsoever, be liable for a breach of privacy / confidentiality by such a party to the extent that such breach is outside our scope of control.

  • OhSoBoho may disclose or transfer your Personally Identifiable Information to an acquirer, assignee or other successor entity in connection with a sale, merger, or reorganisation of all or substantially all the equity, business or assets of OhSoBoho to which your Personally Identifiable Information relates.

  • We may be legally required to disclose your Personally Identifiable Information, if such disclosure is (a) required by subpoena, law or other legal process; (b) necessary to assist law enforcement officials or government enforcement agencies; (c) necessary to investigate violations of or otherwise enforce our legal terms; (d) necessary to protect us from legal action or claims from third parties including you or other users; (e) necessary to protect the legal rights, personal property or personal safety of OhSoBoho, our users, employees and affiliates; or (f) necessary for any other reasonable purpose that OhSoBoho may, in its sole discretion, deem fit.

6. LINKS TO OTHER SITES

If our Platform contains links to third party sites that are not operated by us and you click on a third party link, you may be redirected to such third party’s site. We have no control over, and assume no responsibility for the content, privacy policy or practices of a third party site. We advise you to separately review the privacy policy of every such site you visit.

7. INFORMATION SECURITY

  • We implement security measures designed to protect your information from unauthorised access. Your account is protected by your account password and it is your responsibility to keep the password confidential. We urge you to take steps to keep your Personally Identifiable Information safe by not disclosing your password and by logging out of your account after each use. 

  • We will use generally accepted industry standards to protect information that you have submitted to us against loss, theft, unauthorised access, disclosure, copying, use or alteration as required under the Data Privacy Laws including by implementing certain technological security measures including encryption, two-factor authentication, firewalls and secure socket layer technology. Therefore, although we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security and you assume such risk, your use of the Platform being at your sole risk and discretion.   • We will retain your information for as long as your account is active or as needed by us to provide you the access to the Platform. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes that we are a party to, and enforce our agreements.

We and our partners hold the copyright, and other intellectual property rights to the Platform and all the material on the Platform. We also own all the trademarks displayed on the Platform, unless otherwise indicated. Written permission must be obtained from us before using any of our material.

9. RIGHTS OF THE USER

  • You have a right to opt-out of providing any of your information, including your Personally Identifiable Information. However, in such an event, we reserve the right to refuse or limit your access and use of the Platform, and its features.

  • You have the right to withdraw your consent to the use, disclosure or transfer of your information, including your Personally Identifiable Information, and request for its deletion by writing to us at hello@ohsoboho.in. However, in such an event, we reserve the right to refuse or limit your access and use of the Platform, and its features. 

  • You have the right to update or correct any of your information, including your Personally Identifiable Information. You may do so by writing to us at hello@ohsoboho.in. 

  • We fully comply with applicable laws regarding spam. You can always opt-out of receiving further promotional correspondence from us or our affiliates.
